2 תאור כללי של הקורס: הקורס יבחן את המסגרת המשפטית והמוסדית של האו"ם, אמנת היסוד שלו, אופיו, כוחותיו וסמכויותיו. במהלכו תיבחנה סוגיות משפטיות נבחרות ובכלל זה חברות באו"ם, חוקיות השימוש בכוח, התערבות הומניטרית, "אחריות להגן", בתי דין בינלאומיים פליליים, כוחות השלום של האו"ם ואחריות ארגונים בינלאומיים. בתוך כך יבחן הקורס את הפרקטיקה של הארגון, של המדינות החברות וערכאות משפטיות, ואת האופן שבו הפרקטיקה פירשה, יישמה ופיתחה את עקרונות האו"ם, או סטתה מהם. מטרות הקורס: להחדיר לתלמידי הקורס מודעות לדינמיקה הפנימית של האו"ם, לכוחות הפוליטיים המשפיעים על הליך קבלת ההחלטות, ולתפקיד הארגון והשפעתו על האירועים הבינלאומיים והתפתחות המשפט הבינלאומי. תוצרי למידה בסיומו של קורס זה, סטודנטים יהיו מסוגלים: להכיר את המסגרת המשפטית של האו"ם, האמנה המכוננת ועקרונות היסוד של הארגון. להעריך את תרומתו של ארגון האו"ם להתפתחות המשפט הבינלאומי בכלל, ומערכת השפיטה הבינלאומית הפלילית, בפרט. לבחון את המשחק ההדדי שבין פוליטיקה למשפט בהליך קבלת ההחלטות של האו"ם. לנתח באופן ביקורתי את כוחו של האו"ם (ומגבלותיו) להשפיע על המאורעות הבינלאומיים (סוגיית ההתערבות ההומינטרית ו"אחריות להגן"). לפתח מדיניות לאומית בהתאם לעקרונות היסוד של האו"ם. לחשוב בצורה עצמית על הצורך ברפורמות באו"ם בעידן הגלובליזציה. דרישות נוכחות (%): 80% שיטת ההוראה בקורס:הרצאות רשימת נושאים / תכנית הלימודים בקורס: הליך ארגונה של החברה הבינלאומית בראיה הסטורית. 2. אופיו ומאפייניו העיקריים של האו"ם, וזכויות וחסינויות היתר להן הוא זכאי. 3. המבנה הארגוני של האו"ם, והכוחות והסמכויות של האורגנים הראשיים שלו. 4. חברות באו"ם. 5. שלום ובטחון, והאסור על השמוש בכוח וחריגיו. 6. התערבות הומניטרית. 7.
